SECTION27 welcomes the Competition Commission’s decision to launch a market inquiry into the Grocery Retail Sector. This decision follows years of focus on the part of the Commission on markets relating to food and a number of important findings on, among others, price-fixing in the milk, poultry and bread markets. The Competition Commission now looks to the food retail sector, using its newly acquired market inquiry powers. SECTION27 has made submissions on the terms of reference for the market inquiry, encouraging the Commission, among others, to acknowledge the importance of the market inquiry into the grocery retail sector for realising the broad public interest purposes of the Competition Act and to consider the constitutional context of the right to food in its competition assessment.
