SECTION27 has read the Department of Basic Education’s (DBE) “Response to the order of the North Gauteng High Court delivered on 4 October 2012 on the matter between SECTION27 et al and the Minister of Basic Education et al”, dated 5 October 2012 and published in several weekend newspapers.
SECTION27 welcomes the release yesterday of the report of the Presidential Task Team established to investigate non-delivery of textbooks to Limpopo schools. The report finds that the textbooks crisis arose from the failure of firstly, the Limpopo Department of Education and then the National Department of Basic Education (DBE) to procure and deliver CAPS textbooks.
SECTION27 welcomes the judgment handed down by Judge Kollapen this morning in the matter of SECTION27 versus the Department of Basic Education (DBE). The judgment deals with a continued failure by the DBE and the Limpopo Department of Education to deliver textbooks across Limpopo and to put in place an effective catch-up plan. The fact is that the DBE has repeatedly said that textbooks have been delivered; yet in court they conceded that this was not true.
Tomorrow, the North Gauteng High Court will hand down judgment on the application brought by SECTION27, Hanyani Thomo Secondary School and Lutandale Primary School, represented by the Centre for Applied Legal Studies.

Today SECTION27, Hanyani Thomo Secondary School and Tondani Lydia Masiphephethu, represented by the Centre for Applied Legal Studies, again approached the North Gauteng High Court in relation to the failure by the Department of Basic Education (DBE) to deliver textbooks to Limpopo schools for 2012.
The Council for the Advancement of the South African Constitution (CASAC) is deeply concerned that Mr Solly Tshitangano, the former Acting Chief Financial Officer in the Limpopo Department of Education, was dismissed in December last year despite playing such a valiant role in exposing evidence of corruption and maIadministration in that Department.
Solly Tshitangano is a man who should be celebrated as a hero for his role in exposing irregularities in the textbook tender in Limpopo. For over two years he has been at the forefront of efforts to expose irregularities in the contract awarded to EduSolutions in 2010.
