On 19 March 2018, retired Deputy Chief Justice Dikgang Moseneke read out the order in the Life Esidimeni alternative dispute resolution. In it he ordered the State to pay R180,000 in damages for emotional shock and trauma and R20,000 as part of funeral costs for deceased mental health care users. Moseneke J also ordered that the State pay one million rand each to all claimants, provide counselling and support services to each of the claimants and erect a monument in remembrance of the victims of the Life Esidimeni Marathon Project “as appropriate relief for the [it’s] unjustifiable and reckless breaches” of the Constitution.
